Welcome to Bob the Ozzy Artist. By accessing or leasing from this website, you agree to the following terms and conditions:

1. Eligibility

• Art leasing is available only to registered businesses located within 50km of Caboolture, QLD.

• Leasing is not available for personal or residential use.

• Delivery, staging, and collection are available Monday to Friday, between 7:00 am and 4:00 pm.

 

2. Lease Duration & Renewal

• Each leasing plan has a minimum duration of three (3) months, after which it is automatically renewed every three (3) months until cancelled.

• Cancellation may be completed by sending an email to info@bobtheozzyartist.com.au

• The lease remains active until all leased artworks have been collected by Bob The Ozzy Artist and/or associates.

 

3. Payment Terms

• All lease payments must be made in advance via the approved payment method (Square or direct invoice).

• If payment is not received within seven (7) days of the due date:

  • The artwork will be collected within 24 hours (on day 8), or

  • The business will be invoiced for the full retail value of the artwork.

• Prices are listed in Australian Dollars (AUD) and include GST where applicable.

• Leases are valid only once the first payment has been received.

 

4. Delivery, Staging & Collection

• Delivery will be arranged once the first payment has been received, and the agreed date and time will be confirmed by email.

• Upon delivery, Bob The Ozzy Artist and/or associates will stage the artwork in a location agreed upon with the lessee to ensure optimal presentation and safety.

• Once staged, the artwork must remain in the same position for the duration of the lease.

• If the lessee moves or repositions the artwork, they assume full responsibility for any resulting damage, instability, or environmental risk.

• Collection must be requested at least 10 days in advance via email to info@bobtheozzyartist.com.au .

• All deliveries and collections take place Monday to Friday between 7:00 am and 4:00 pm.

 

5. Artwork Replacement & Sales

• Bob The Ozzy Artist and/or associates reserves the right to retrieve or replace leased artworks at any time if they are sold or required for an exhibition.

• If retrieval is required, the lessee will be notified by email with the scheduled collection date and time.

• Collection will occur before the next billing cycle, and where possible, a replacement artwork of similar size, value, or style will be provided.

 

6. Care, Damage & Loss

• The lessee business accepts full financial responsibility for all leased artworks during the lease period.

• In the event of damage, loss, or theft, the lessee must pay the full retail value of the artwork.

• Artworks must be displayed in a secure indoor space, protected from sunlight, moisture, heat, or vibration.

• Lessees are responsible for ensuring that artworks remain safely mounted, positioned, or placed.

• Bob The Ozzy Artist strongly recommends that all leased artworks are covered under the lessee’s business insurance policy for the full retail value of the leased items.

 

7. Condition Reports

• Each artwork will be inspected and photographed prior to delivery.

• A signed condition report will confirm the state of each artwork at the start of the lease.

• This report will be reviewed again upon collection to verify condition and resolve any discrepancies.

• Any concerns about the condition of an artwork upon delivery must be reported within 24 hours of receipt via email.

 

8. Non-Compliance

• Bob The Ozzy Artist reserves the right to terminate the lease without refund if the lessee fails to comply with these terms, including but not limited to:

  • Failure to make timely payment,

  • Negligent handling, movement, or misuse of artworks,

  • Breach of insurance or care requirements, or

  • Refusal to allow reasonable collection when due.

• Upon termination, Bob The Ozzy Artist and/or associates may retrieve all leased artworks immediately and invoice the lessee for any outstanding or resulting costs.

 

9. Liability

• Bob The Ozzy Artist and/or associates take every precaution to ensure safe delivery, installation and collection of artworks.

• However, Bob The Ozzy Artist is not liable for any injury, damage, or financial loss resulting from the lessee handling, restaging or moving the leased artworks.

 

10. Inspection Rights

• Bob The Ozzy Artist and/or associates reserves the right to inspect leased artworks during the lease period, with reasonable notice, to verify condition and display compliance.

• Inspections will be coordinated with the lessee to ensure minimal disruption to the business environment.

 

11. Display Guidelines

• Artworks should be displayed in a location consistent with professional business presentation.

• Lessees must not sublease, relocate, or lend the artworks to third parties.

• Artworks may not be altered, framed, or modified in any way.

• Adhesives, nails, or fasteners should not be applied directly to artworks unless previously approved by Bob The Ozzy Artist.

 

12. Force Majeure

Bob The Ozzy Artist is not liable for any delay or failure to perform under this agreement due to circumstances beyond reasonable control, including natural disasters, illness, transportation issues, or government restrictions.

 

13. Intellectual Property

• All leased artworks remain the intellectual and physical property of Bob The Ozzy Artist.

• The lessee has no rights of reproduction, modification, or ownership transfer through the leasing arrangement.

• Promotional use or photography of the artworks for business marketing purposes is permitted only with prior written approval.

 

14. Termination by the Lessee

• The lessee may terminate the lease at the end of any three-month period by sending an email to info@bobtheozzyartist.com.au.

• Termination requests must be made at least 10 days prior to the renewal date to avoid the next billing cycle.

• Once termination is processed, Bob The Ozzy Artist and/or associates will arrange collection of the leased artworks on a mutually agreed date and time.

 

15. Governing Law

• These terms are governed by the laws of Queensland, Australia.

• Any disputes will be managed under Queensland jurisdiction, and both parties agree to cooperate in good faith before initiating legal action.

 

16. Amendments

• Bob The Ozzy Artist reserves the right to update or amend these terms at any time.

• Any changes will take effect immediately for new leases, or from the next renewal period for existing leases.
